Martin Bader

Martin Bader is an associate in the Litigation practice of Paul Hastings in the San Diego office. He focuses on all aspects of intellectual property law, particularly patent litigation, prosecution, trademark litigation and prosecution and client counseling. Martin represents technology companies in the enforcement and procurement of intellectual property rights as well as counsels clients with regard to infringement and validity of third-party patents. His practice in a wide variety of technology areas including: analog and digital electronics, communications systems, network systems, computer software, Internet technologies, radar systems, packaging of semiconductor devices, electro mechanical systems, mechanical systems, and signal processing.

Martin is currently representing Kyocera Wireless, Inc. against Datascape, Inc. in a six patent infringement action in the Northern District of Georgia.  The accused technology relates to data communications and Internet access in wireless devices.

Martin recently represented MRV Communications, Inc., a leading provider of telecommunications equipment, against Apcon after Apcon began threatening MRV's customers with patent infringement and finally brought an infringement action. MRV countersued for invalidity based on prior art and went on the offensive with claims of patent misuse, inequitable conduct, and unfair competition. Apcon subsequently surrendered its patent suit by agreeing to a no payment walk-away settlement and further agreed to issue a press release stating that MRV's products do not infringe any Apcon patent and that MRV's customers can conduct business related to MRV's products without fear of reprisal from Apcon.

He also recently represented MediaTek, Inc., a Taiwanese based fabless IC company, against Sanyo Electric Co., Ltd. in the Eastern District of Texas. The matter, valued at over $200 million, involved three patents covering integrated chipset solutions for compressing video and audio data in cameras, DVDs and televisions.
Martin received his B.S. degree in electrical engineering from California Polytechnic State University, San Luis Obispo in 1999.

Martin received his J.D. degree, magna cum laude, from University of San Diego in 2002, where he was a member of the Order of the Coif and the San Diego Law Review. He is a member of the California bar and is also registered to practice before the United States Patent and Trademark Office.
